Wesbiter provides an AI-powered customer support automation platform that enables businesses to create and manage chatbots for messaging platforms such as WhatsApp and Facebook Messenger. Our Services include tools for bot creation, conversation management, keyword rules, and analytics.

Account Registration and Security

To use certain features of our Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

Use of Services

You retain ownership of any content you create or upload through the Services. By using the Services, you grant Wesbiter a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing the Services to you.

Payment and Billing

Certain features of the Services may require payment. By subscribing to a paid plan, you agree to pay all fees associated with your subscription. Fees are billed in advance on a monthly or annual basis, as applicable. All fees are non-refundable except as required by law or as otherwise stated in your subscription agreement.

We reserve the right to change our pricing at any time. Price changes will be communicated to you in advance and will apply to subsequent billing periods. If you do not agree to a price change, you may cancel your subscription before the change takes effect.

Termination

You may terminate your account at any time by contacting us or using the account deletion features in the Services. We reserve the right to suspend or terminate your account and access to the Services at any time, with or without notice, for any reason, including if you violate these Terms.

Upon termination, your right to use the Services will immediately cease. We may delete your account and data, subject to our data retention policies and applicable legal requirements.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WESBITER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES.

Indemnification

You agree to indemnify, defend, and hold harmless Wesbiter and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Services or violation of these Terms.

Changes to Terms

We may modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after any changes constitutes acceptance of the modified Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Wesbiter operates, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration or in the courts of the applicable jurisdiction, as determined by applicable law.
